Sensitive information collected in the context of civil aviation accident investigations

Publication for low-value contract with an estimated maximum value of EUR 25.000. Negotiated procedure.

The Directorate-General for Mobility and Transport of the European Commission is planning to award a contract for a study regarding Regulation (EU) No 996/2010 on the Investigation and Prevention of Accidents and Incidents in Civil Aviation (OJ L 295 of 12.11.2010, p. 35) in order to understand the nexus between protecting sensitive safety information collected in the context of a technical accident investigation and the handling of such information by the judiciary.

The aim is to obtain an inventory of national legislation and practices for handling sensitive information, which has been collected in the context of accident investigations by national courts and in judicial procedures.

The study should describe national legislation and practices, using both quantitative and qualitative methods. It should collect information on court cases or other cases, which underline any possible tensions between the technical and judicial investigations related to aviation safety.

The study should examine the period from 02/12/2010, when the Regulation entered into force, until 30 June 2019, in the 28 EU Member States as well as a selection of relevant third countries.
