Rule on the return of the vehicle
Update October 2024: In a judgment of 4 October 2024, the Court of Justice of the European Union (CJEU) declared void the provision on the return of the vehicle to the Member State of establishment under Article 5(1)(b) of Regulation (EC) No 1071/2009 of the European Parliament and of the Council of 21 October 2009 establishing common rules concerning the conditions to be complied with to pursue the occupation of road transport operator (Article 1(3) of Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 2020 amending Regulations (EC) No 1071/2009, (EC) No 1072/2009 and (EU) No 1024/2012 with a view to adapting them to developments in the road transport sector (OJ L 249, 31.7.2020, p. 17), insofar as it amends Article 5(1)(b) of Regulation (EC) No 1071/2009 of the European Parliament and of the Council of 21 October 2009 establishing common rules concerning the conditions to be complied with to pursue the occupation of road transport operator and repealing Council Directive 96/26/EC (OJ L 300, 10.7.2012, p. 51).
In accordance with Article 264 of the Treaty on the Functioning of the European Union, the decision of the Court has direct effect within the EU legal order.
