Rule on the return of the vehicle
Update October 2024: In its judgment of 4 October 2024, the Court of Justice of the European Union (CJEU) annulled Article 5(1)(b) of Regulation (EC) No 1071/2009 establishing common rules concerning the conditions to be complied with to pursue the occupation of road transport operator (inserted by Article 1(3) of Regulation (EU) 2020/1055 of the European Parliament and of the Council of 15 July 2020) which laid down the obligation for vehicles used for international transport to return to an operational centre situated in the Member State of establishment of the transport undertaking concerned every eight weeks.
The decision of the Court has a direct effect within the EU legal order. In accordance with Article 264 of the Treaty on the Functioning of the European Union, the provision is therefore to be considered void and not applicable within the EU since the date when the act was adopted, on 15 July 2020.
